According to its author, Engineered Death is not a book about the morality of homicide but about intellectual self-consistency—in particular about the self-consistency of the “liberal” view of homicide. The “liberal” view is defined by Woods as the view that murder is morally wrong because, and only because, it is a violation of rights. He tells us that he is concerned to defend neither liberalism in general nor its notion of individual rights in particular, but only to work out the (...) implications of these assumptions for the problems of abortion, suicide, euthanasia, and senecide. It is only in this sense that Woods' disclaimer about the non-ethical nature of his book can be taken seriously. In every other respect it is a treatise on ethics. Selected by Choice as one of the outstanding publications for 1991. Are risk debates disputes between those who accept the findings of science and those who do not? Between good and bad science? Or is it possible that opposing assessments of risk, by scientific experts as well as ordinary citizens, reflect and are guided by dominant values held by the assessors? The following analysis of one of these debates supports the latter view. In The Practice of Punishment, Wesley Cragg sets out a systematic “restorative” theory of criminal punishment. For him, restorative justice identifies the goal of punishment as “the resolution of disputes to which criminal offenses give rise in ways designed to sustain confidence in the capacity of the law to fulfil its legitimate functions on the part of victims of crime and the public at large”.

In his ‘On t and u and what they can do’, Greg Restall presents an apparent problem for a handful of well-known non-classical solutions to paradoxes like the liar. In this article, we argue that there is a problem only if classical logic – or classical-enough logic – is presupposed. 1. Background Many have thought that invoking non-classical logic – in particular, a paracomplete or paraconsistent logic – is the correct response to the liar and related paradoxes. At the most (...) basic level, the target non-classical idea is that some expressions, like ‘all and only the true propositions’, do not behave as we would expect from classical logic. Non-classical theorists argue that the class of all and only the truths is either incomplete or inconsistent: when you truly speak of all and only truths , you're either leaving some truths out, or you're letting some untruths in. Truth, in a slogan, is either gappy or glutty. Non-classicality is not a glib or easy-way-out response to the paradoxes. Innocuous-seeming notions can turn out to be philosophically substantial. Moreover, apparently correct forms of reasoning can turn out to be incorrect. To take a example, a glut theorist must hold that the following argument form is not in general valid. Either p is true or q is true. But p is untrue. So q is true. This argument form may strike our ears as acceptable. But if p is a truth value glut, then the inference fails to preserve truth. According to glut theorists, the inference breaks down in inconsistent contexts: if the subject matter involves gluts, then the inference is to be rejected. And the liar paradox, according to such theorists, shows that truth is exactly the kind of subject matter that yields inconsistency. In the …. (shrink)

A central aspect of people's beliefs about the mind is that mental activities—for example, thinking, reasoning, and problem solving—are interrelated, with some activities being kinds or parts of others. In common-sense psychology, reasoning is a kind of thinking and reasoning is part of problem solving. People's conceptions of these mental kinds and parts can furnish clues to the ordinary meaning of these terms and to the differences between folk and scientific psychology. In this article, we use a new technique for (...) deriving partial orders to analyze subjects' decisions about whether one mental activity is a kind or part of another. The resulting taxonomies and partonomies differ from those of common object categories in exhibiting a converse relation in this domain: One mental activity is a part of another if the second is a kind of the first. The derived taxonomies and partonomies also allow us to predict results from further experiments that examine subjects' memory for these activities, their ratings of the activities' importance, and their judgments about whether there could be "possible minds" that possess some of the activities but not others. A brief review of the conceptual difficulties met by the quantum formalism is presented. The main attempts to overcome these difficulties are considered and their limitations are pointed out. A recent proposal based on the assumption of the occurrence of a specific type of wave function collapse is discussed and its consequences for the above-mentioned problems are analyzed.

If people believe that one activity is a kind of another, they also tend to believe that the second activity is a part of the first. For example, they assert that deciding is a kind of thinking and that thinking is a part of deciding. C. Fellbaum and G. A. Miller's (see record 1991-03356-001) explanation for this phenomenon is based on the idea that people interpret part of in the domain of verbs as a type of logical entailment. Their explanation, (...) however, suffers from at least 2 deficiencies. First, it fails to account for parallel effects with nouns (e.g., a contest is a kind of an activity, and an activity is a part of a contest). Second, it contains a flaw that incorrectly predicts many activities to be parts of each other (e.g., coming is part of going and going part of coming). However, a hypothesis L. J. Rips and F. G. Conrad (see record 1989-24843-001) originally proposed for the kind–part reciprocal effect avoids both of these difficulties. (shrink)

An analysis of student learning with the LISP tutor indicates that while LISP is complex, learning it is simple. The key to factoring out the complexity of LISP is to monitor the learning of the 500 productions in the LISP tutor which describe the programming skill. The learning of these productions follows the power‐law learning curve typical of skill acquisition. There is transfer from other programming experience to the extent that this programming experience involves the same productions. Subjects appear to (...) differ only on the general dimensions of how well they acquire the productions and how well they retain the productions. Instructional manipulations such as remediation, content of feedback, and timing of feedback are effective to the extent they give students more practice programming, and explain to students why correct solutions work. In this work, we provide a broad overview of the distinct stages of E-Discovery. We portray them as an interconnected, often complex workflow process, while relating them to the general Electronic Discovery Reference Model (EDRM). We start with the definition of E-Discovery. We then describe the very positive role that NIST’s Text REtrieval Conference (TREC) has added to the science of E-Discovery, in terms of the tasks involved and the evaluation of the legal discovery work performed. Given the critical nature (...) that data analysis plays at various stages of the process, we present a pyramid model, which complements the EDRM model: for gathering and hosting; indexing; searching and navigating; and finally consolidating and summarizing E-Discovery findings. Next we discuss where the current areas of need and areas of growth appear to be, using one of the field’s most authoritative surveys of providers and consumers of E-Discovery products and services. We subsequently address some areas of Artificial Intelligence, both Information Retrieval-related and not, which promise to make future contributions to the E-Discovery discipline. Some of these areas include data mining applied to e-mail and social networks, classification and machine learning, and the technologies that will enable next generation E-Discovery. The lesson we convey is that the more IR researchers and others understand the broader context of E-Discovery, including the stages that occur before and after primary search, the greater will be the prospects for broader solutions, creative optimizations and synergies yet to be tapped. In organizational psychology the positive effects of democratically structured enterprises on their employees are well documented. However, the longstanding viability as well as economic success of democratic enterprises in a capitalistic market environment has long been contested. For instance, this has given rise to widespread endorsement of the “degeneration thesis” and the so-called “iron law of oligarchy”. By reviewing 77 qualitative studies that examined 83 democratic enterprises within the last 50 years, the present systematic review provides evidence that such enterprises (...) are able to economically survive and prosper. The majority of studied enterprises either resisted pressures toward degeneration or subsequently regenerated after undergoing degenerative processes. Only 9.5% fully degenerated in accordance with the degeneration thesis and the “iron law of oligarchy”, while 27.0% of the democratic enterprises showed diverse and mixed forms of degeneration tendencies, indicating that the notion of an “iron law” needs to be revised. Within the nine investigated cases of Mondragon not one single enterprise or group fully degenerated. Three cases showed degenerative tendencies, another three one degeneration tendencies and simultaneously regeneration, one case fully resisted degeneration tendencies and two cases regenerated. Further, this systematic review provides an overview of organizational and external conditions, non-/democratic or non-/participative practices and psychological phenomena that contribute to the degeneration, regeneration, or resistance to degeneration. The described examples of such practices may help practitioners to implement and maintain democratic structures and processes in contemporary organizations. (shrink)

The recent literature on causality has seen the introduction of several distinctions within causality, which are thought to be important for understanding the widespread scientific practice of focusing causal explanations on a subset of the factors that are causally relevant for a phenomenon. Concepts used to draw such distinctions include, among others, stability, specificity, proportionality, or actual-difference making. In this contribution, I propose a new distinction that picks out an explanatorily salient class of causes in biological systems. Some select causes (...) in complex biological systems, I argue, have the property of enabling coherent causal control of these systems. Examples of such control variables include hormones and other signaling molecules, e.g., TOR (target of rapamycin), morphogens or the products of homeotic selector genes in embryonic pattern formation. I propose an analysis of this notion based on concepts borrowed from causal graph theory. (shrink)

Several authors have used the notion of causal specificity in order to defend non-parity about genetic causes (Waters 2007, Woodward 2010, Weber 2017, forthcoming). Non-parity in this context is the idea that DNA and some other biomolecules that are often described as information-bearers by biologists play a unique role in life processes, an idea that has been challenged by Developmental Systems Theory (e.g., Oyama 2000). Indeed, it has proven to be quite difficult to state clearly what the alleged special (...) role of genetic causes consists in. In this paper, I show that the set of biomolecules that are normally considered to be information-bearers (DNA, mRNA) can be shown to be the most specific causes of protein primary structure, provided that causal specificity is measured over a relevant space of biological possibilities, disregarding physical as well as logically possible states of the causal variables. The first issue of Artificial Intelligence and Law journal was published in 1992. This paper offers some commentaries on papers drawn from the Journal’s third decade. They indicate a major shift within Artificial Intelligence, both generally and in AI and Law: away from symbolic techniques to those based on Machine Learning approaches, especially those based on Natural Language texts rather than feature sets. The US neutrino community gathered at the Workshop on the Intermediate Neutrino Program at Brookhaven National Laboratory February 4-6, 2015 to explore opportunities in neutrino physics over the next five to ten years. Scientists from particle, astroparticle and nuclear physics participated in the workshop. The workshop examined promising opportunities for neutrino physics in the intermediate term, including possible new small to mid-scale experiments, US contributions to large experiments, upgrades to existing experiments, R&D plans and theory. The workshop was organized into (...) two sets of parallel working group sessions, divided by physics topics and technology. Physics working groups covered topics on Sterile Neutrinos, Neutrino Mixing, Neutrino Interactions, Neutrino Properties and Astrophysical Neutrinos. Technology sessions were organized into Theory, Short-Baseline Accelerator Neutrinos, Reactor Neutrinos, Detector R&D and Source, Cyclotron and Meson Decay at Rest sessions.This report summarizes discussion and conclusions from the workshop. Schober et al. describe two studies on how survey interview respondents misunderstand interview questions. After answering a survey, participants are given standardized definitions of the questions they have just answered. Even apparently simple questions such as “Have you smoked more than 100 cigarettes?” are interpreted very differently by participants. Moreover, clarifying the meaning of the definitions with the interviewer does not always help resolve the miscommunication.

Fifty papers have been selected from the thirteen conferences and each of them is described in a short subsection individually written by one of the 24 authors. These subsections attempt to place the paper discussed in the context of the development of AI and Law, while often offering some personal reactions and reflections.
